Welcome to MAVN Golf. These Terms of Service ("Terms") govern your access to and use of the website located at www.mavn.golf (the "Site"), as well as the products, services, memberships, coaching, and facilities offered by [LEGAL ENTITY NAME], doing business as MAVN Golf ("MAVN Golf," "we," "us," or "our").
By accessing the Site, submitting a form, booking an appointment, purchasing a membership, or using our facility, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. Eligibility
You must be at least 18 years old to enter into an agreement with us, purchase a membership, or use our facility unsupervised. Minors may use the facility only with the consent and supervision of a parent or legal guardian, who accepts responsibility on the minor's behalf.
2. Services and Memberships
MAVN Golf provides indoor golf performance services, including instruction, biomechanics-based coaching, fitness training, and access to technology and facilities. Specific services, membership terms, and pricing are discussed and confirmed directly with you during a consultation or sales call. The Site does not constitute an offer to sell at any particular price.
Membership terms, billing cycles, commitment periods, and cancellation policies are set out in the separate membership agreement you enter into with us. In the event of a conflict between these Terms and your membership agreement, the membership agreement controls.
3. Bookings, Appointments, and Cancellations
When you book a session, assessment, or appointment, you agree to any scheduling, cancellation, and no-show policies communicated to you at the time of booking or in your membership agreement. We reserve the right to reschedule or cancel sessions and will make reasonable efforts to notify you in advance.
4. Assumption of Risk and Waiver of Liability
Please read this section carefully. It affects your legal rights.
Use of our facility involves physical activity, including swinging golf clubs, using fitness and exercise equipment, and operating or being near technology and equipment. These activities carry an inherent risk of injury. By using our facility and services, you acknowledge and voluntarily assume all risks associated with such activities.
To the fullest extent permitted by law, you agree to release, waive, and hold harmless MAVN Golf, its owners, employees, coaches, and agents from any and all claims, liabilities, or damages arising out of or related to your use of the facility, equipment, or services, except to the extent caused by our gross negligence or willful misconduct.
You represent that you are physically fit to participate and have no medical condition that would prevent safe participation. You should consult a physician before beginning any new fitness or training program. (A separate signed liability waiver may be required before facility use.)
5. Facility Rules and Conduct
You agree to follow all posted rules, safety instructions, and reasonable directions from our staff while at the facility. We may suspend or terminate your access for conduct that is unsafe, disruptive, abusive, or that damages our property or equipment. You are responsible for any damage you cause beyond normal wear and tear.
6. Communications and SMS Consent
By providing your phone number and opting in, you consent to receive informational and marketing text messages from MAVN Golf, including messages sent via autodialer. Consent is not a condition of purchase. Message and data rates may apply, and message frequency varies. You may opt out at any time by replying STOP. 7. Intellectual Property
The Site and all content on it — including text, graphics, logos, video, coaching materials, and the MAVN Golf name and branding — are owned by or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission. Coaching materials and assessments provided to you are for your personal use only.
8. User Submissions
Any information you submit through forms on the Site must be accurate and your own. If you provide reviews, testimonials, or other content, you grant us a non-exclusive, royalty-free license to use that content in connection with our business and marketing.
9. Third-Party Services
The Site may use or link to third-party services (for example, scheduling, payment, email, or analytics providers). We are not responsible for the content, policies, or practices of those third parties. Your use of them is governed by their own terms.
10. Disclaimers
The Site and our services are provided "as is" and "as available." We do not guarantee any specific athletic, performance, fitness, or health outcome from our coaching or services. Results vary based on individual effort, ability, and other factors. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
11. Limitation of Liability
To the fullest extent permitted by law, MAVN Golf and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. Our total liability for any claim will not exceed the amount you paid to us in the [SIX (6)] months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless MAVN Golf from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or facility, your violation of these Terms, or your violation of any law or the rights of a third party.
